By submitting materials to Phoenix Refining, you agree to the following:

At Ace Contractors Group, we are committed to protecting your privacy and handling your personal data responsibly. This Privacy Policy explains how we collect, use, and safeguard your information when you visit our website, use our services, or contact us. We comply fully with the UK General Data Protection Regulation (UK GDPR) and other applicable data protection laws.

1. Ownership and Eligibility

You confirm that:

  • You are aged 18 or over.
  • You are the legal owner of the materials submitted.
  • The items are not stolen and are free from third-party claims.
  • You have the right to sell the materials to Phoenix Refining.

We may request proof of identity, ownership or source of funds before proceeding.

2. Website Prices and Estimates

Prices, calculators, quotations and examples shown on our website are for guidance only and are not legally binding.

No contract exists until:

  1. We receive your materials.
  2. We test and assess them.
  3. We make a final offer.
  4. You accept that offer.

We reserve the right to amend, withdraw or refuse any quotation or transaction before payment is made.

3. Testing and Valuation

All materials may be weighed, XRF tested, assayed or otherwise examined to determine their precious metal content.

Our final valuation will be based on the results of our testing and current market prices. Customer descriptions and stated purity are not binding.

4. Final Offer

You are under no obligation to accept our offer.

If you decline, your materials can be returned at your expense and risk. We may deduct reasonable testing, handling, shipping or insurance costs where applicable.

5. Payment and Ownership

Accepted offers are normally paid by bank transfer.

Ownership of the materials passes to Phoenix Refining once payment has been made. After payment, the transaction is final and cannot be reversed.

6. Anti-Money Laundering and Fraud Prevention

We reserve the right to request:

  • Photo identification.
  • Proof of address.
  • Evidence of ownership.
  • Bank account verification.
  • Any other information required by law.

We may delay payment, refuse a transaction or report suspicious activity where required.

7. Shipping and Insurance

Materials sent to Phoenix Refining remain the sender’s responsibility until received and acknowledged by us.

Customers should:

  • Package items securely.
  • Use a tracked and insured delivery service.
  • Keep proof of posting and tracking information.

Phoenix Refining is not responsible for loss or damage during transit.
Materials may be delivered in person by prior appointment only.

8. Returns

If we do not proceed with a transaction, or if you decline our offer, materials may be returned at your cost and risk.

Additional insurance or special delivery services can be arranged at your expense.

9. TRight to Refuse Transactions

Phoenix Refining may refuse, suspend or cancel any transaction where:

  • Ownership cannot be verified.
  • Identification requirements are not met.
  • Materials are contaminated, unsafe or misdescribed.
  • Fraud or unlawful activity is suspected.
  • Market conditions make the transaction impractical.
  • Website, pricing or system errors occur.

10. Storage

Materials not collected or returned within 90 days may incur storage charges.

If no instructions are received within that period, we reserve the right to sell or dispose of the materials to recover our reasonable costs, subject to applicable law.

11. Privacy

Personal information is processed in accordance with UK data protection laws and may be used for:

  • Processing transactions.
  • Identity verification and fraud prevention.
  • Regulatory compliance.
  • Customer communications and record keeping.

Information may be shared with banks, insurers, delivery companies, identity verification providers and authorities where legally required.

12. Limitation of Liability

Phoenix Refining is not liable for:

  • Market price fluctuations.
  • Differences between website estimates and final valuations.
  • Delays caused by circumstances beyond our control.
  • Loss of profits or indirect losses.

Our liability will never exceed the amount paid for the materials concerned.

13. Force Majeure

We are not responsible for delays or failures caused by events outside our control, including postal delays, power failures, natural disasters, industrial disputes, market disruptions or changes in law.

14. Complaints If you are unhappy with our service, please contact us with details of your transaction and complaint. We will aim to acknowledge complaints within five working days and respond as soon as reasonably possible.

15. General

Electronic communications by email, telephone or text are valid forms of communication.

Failure by Phoenix Refining to enforce any part of these Terms does not waive our rights.

If any part of these Terms is found to be invalid, the remainder will continue to apply.

These Terms are governed by the laws of England and Wales.
